One problem: Despite bias in the media, HTC claims that the ITC lawyer argued that HTC did not infringe. Which means that HTC has a good shot at the appeal... Also, one of the Apple patents has prior art..its called BeOS...it had some of the features/claims and was out in the market commercially in 1995.
