Whether Copilot itself violates GPL or not is one issue. Whether the code produced by Copilot violates GPL or not is a whole different independent issue. If I am walking down the street, find a piece of paper with code on it, pick it up and add the code to my program and this code turns out to be licensed under the GPL then my program becomes a derivative work. It doesn't matter who wrote it on that piece of paper, whether it's a 100% correct copy of the GPLed code or not or if there are mistakes in it.
