This gives the police the power to force folks to give their passwords to the police when there is a valid search warrant issued for the electronic device.
Not saying its great, but at least they have to have an actual search warrant for it first.
- xnyan 5y agoThe law gives police the right "to seize any material found at that place or in the possession of a person present at the place" and "to request assistance from persons present so as to gain access" It sounds like anything found at the at the address of the search warrant is a valid target, and you are legally required to assist no matter the reason that you or your device was there. A search warrant is extremely powerful and should clearly spell out what it's searching for. If the police find something outside of the scope of the warrant, at very least they should be required to go back to the judge and justify why they should have access to it.
- anfilt 5y agoI don't think Ireland scopes their warrants like the US. I think warrants are location based.
