N.Y. State Low-Cost Broadband Law Blocked by U.S. Judge
- netizen-936824 5y ago'Hurley said in a ruling Friday that the service New York seeks to regulate “has never been subject to rate regulation at the federal or state level.”' In what universe is this acceptable logic? They identified a problem industry that needs regulation that doesn't have any, so they draft regulation. Judge says 'this wasn't regulated before so you can't do that now' What ???

- salawat 5y agoIt may be that the structure of the act that created the FCC pre-empts, although I'm interested in hearing the justification for why "more stringent regulation" at the State level is okay for environmental regulations, but not for telecom when there is not a contraindicated Constitutional issue at work here. Unless the Telco lobby is going for an inter-state commerce argument in order to shoe in more power at the Federal level as usual.
