I’m not sure I agree with your assertion. That's a bail hearing.

  Government says "these people shouldn't get bail as they are insurrectionists" and judges say "if they didn't commit any violence, then no, they aren't a threat and will be released on bail". The gov't is losing a lot of their arguments in the courtroom trying to paint it as an insurrection versus a protest.
