Not sure I follow, if this happens to some customer (who are in the right) they shouldn't get a refund? And this is considered just because it saves investigation spending? If Amazon chooses to refund without question to save disputes money, that's their choice. But it's not the customer's problem. If you pay for something and you don't receive it, you must get refunded.
