What would be really awesome of Google to do then is, if they do lock an account out due to an age-based TOS violation, still provide access to Google Takeout (and add Gmail to the supported services list) so the kid could at least easily get his data back. IANAL, so I don't know if he technically would not be allowed to access Google Takeout either via the TOS, but if Google's lawyers could incorporate an exception of some sort for age-based violations, then this would at least be a super nice thing for them to do.
