Prop 47 made this the threshold for a Felony. Misdemeanor shoplifting can still be up to 6 months in prison. In practice it's not, but that's something to take up with the police, prosecutors, and judges.
- gnicholas 5y agoThe issue in SF is the prosecutor. Police decide whom to arrest based on what will be prosecuted, so that is a downstream decision. The judges could reduce sentences if these cases ever got in front of them, but in reality they never have the opportunity to weigh in.
