GitHub Restores Reverse-Engineered GTA Code Following DMCA Counter Notice
- brrrrrm 5y agoWhat are the legal risks faced by Theo in this case? I’m guessing it’s not simply another DMCA takedown
- jrochkind1 5y agoIn US law there are both civil and criminal penalties possible for copyright infringement, depending on the nature, if found guilty in court. https://info.legalzoom.com/article/consequences-violations-copyright-laws https://info.legalzoom.com/article/consequences-violations-c...
- aaomidi 5y agoSigh. Criminal penalties for copyright. I love how ridiculous our IP laws are.
- supergirl 5y agosoo all you have to do is dispute the DMCA and your content is back online, by law? and the only next step is for the rights holder to sue you? that doesn't sound right. everyone would be doing it on youtube. or actually, it does sound right, but I doubt it's how it's done in practice.
- jrochkind1 5y agoThat is exactly how it works under the DMCA, yes. There are wait times involved, so it can take a few weeks to get it back up. I am not sure if Youtube follows the DMCA or they're doing their own thing -- the DMCA doesn't necessarily say they have to put it back up or can't take it down under other circumstances, can't do their own thing. Github follows the DMCA.
- BlueTemplar 5y agoYouTube does their own thing with ContentID, which most copyright holders use : https://news.ycombinator.com/item?id=27072092 https://news.ycombinator.com/item?id=27072092
- aaomidi 5y agoWhat would you propose it be? The copyright holder needs to prove that the other party is breaking the law.
