You're missing the point. JPKab's point was that pursuing justice would be very costly to his brother (assuming that he didn't win). I can't see how pursuing justice is costly to your sister (my condolences!). There is a low chance of success in both of those pursuits. Clearly the original crime is costly in both cases, much more so in the case of your sister!
