I have very little experience with the industry, but I think car manufacturers are playing a game of chicken to see who will sell a Level 3-certified car first because, while the law supposedly clearly lays out the legal details, in practice there is no prior work for judges and juries to work off of. It's brand new territory, and no one wants to be the first one in. Tesla has discovered they can bypass this because "Full Self Driving Beta" is not a regulated term and it sells like hot-cakes to consumers. I am sure other companies are/will be following suit. No one wants to stamp an official "LEVEL 3/4/5 CERTIFIED" sticker on the official sales sheet.
