- sneak 5y agoIt's a factually accurate statement; I don't think IBM is claiming rights to 100% of their time, just that they are bound by their contractual obligations as an employee (and function as a representative of the company) 100% of the time - which is true and correct.
- cortesoft 5y agoIt's not abnormal for employers to put conduct clauses in contracts that impact life outside of your work hours. For example, you are likely not allowed to say bad things about your employer online, even if you are off the clock. Athletes often have clauses about not being allowed to do certain risky activities to avoid injury. You might be on call during off hours.
- mschuster91 5y agoAt least in Germany, these clauses are unenforceable on regular low level staff.
- Rebelgecko 5y agoTrying to pull a move like "I only have to follow NDAs when I'm clocked in and using my work email account" wouldn't fly at ANY company I've ever worked at.
