Note that this judge denied the motion for a mistrial. He didn’t think the jurors would be threatened enough by such words to alter their verdict to protect their own property/lives. However he is noting that an appeals court may decide differently. In short, it’s creating risk for the plaintiffs, which is self defeating for Maxine Waters.
Personally I feel that urging people to get “confrontational” if they don’t get the verdict they want from a lawful process of our justice system seems much more like incitement of violence than anything Trump said in his January 6th speech, which explicitly had called for a peaceful march (transcript: https://www.rev.com/blog/transcripts/donald-trump-speech-save-america-rally-transcript-january-6 https://www.rev.com/blog/transcripts/donald-trump-speech-sav...) but was nevertheless widely reported as incitement and resulted in permanent bans of Trump across every social media/tech platform. This isn’t the first controversy for Maxine Waters either, and I wonder if she will face a similar ban across these platforms (unlikely).
