As with almost everything it is a matter of tolerance levels.
You can in some countries say someting is fat-free (or sugar-free) if it contains less than 0.5 grams per serving. Lactose-free stuff still contains a very small amount of lactose. Alcohol-free beer can still contain very small traces.
The amount of flavoring oils needed in soda is so extrememly small (it is that potent) that it has virtually no effect on caloric intake and is therefore practically fat-free.
