I like all your points, but I think them all kinda... irrelevant? Being 'dinged' what could easily be more than $150k is a penalty that is almost certain to have massive repercussions on someone's life. Even if we assume complete guilt, full knowledge of the law, and willful intent to disregard it to do the job... in what world is it sane to economically trash someone's life over a mistake like this?
