I could see this one having the opposite effect.
Generally, companies review what amounts to circumstantial, incomplete, or conflicting evidence that wouldn't amount to an award or criminal conviction in court and agree to exchange
1. money (settlement)
2. promised disciplinary action
3. other compensation / action
for silence (NDA) on the part of the complainant (or victim) AND THE COMPANY relating to the issue.
Court is ALWAYS an option for victims and many choose to to the settlement option because they don't have a strong, provable case or don't want to relive the experience through public testimony. Sometimes there are facts that make the victim/complainant look bad that they don't want released, and the NDA protects them in these cases.
If the law allows one side out of the NDA without penalty, then settlements will disappear and victims will have to go to court for restitution.
