It can be legal if it’s hyperbole. Lots of people say things like “I’m gonna kill him” without actually committing a crime.

Same as a comedienne that did a picture of a beheaded president and mockingly said, blood coming out of his eyes... his whatever. If someone did something similar for the now president I imagine some people would have issue with it.
