As per the article, looks as if it has been taken from earlier legislation. Noted here in 2008 [1] but wouldn’t surprise me if it dates back much further. Given the size of the legal document (~2000 pages) I’m hardly surprised that this sort of boilerplate gets copy/pasted. The real question is whether this sort of oversight is indicative of the quality of the rest of the text - though I suspect time and effort will have gone into the substantial “non-boilerplate” parts (with any luck). Either way, the European Parliament won’t be debating this until February so it’s only provisional until then meaning there’s plenty of time to comb through it and make adjustments.
