Being an immigrant without legal status is not technically in itself a crime. It's a civil matter not a criminal one. A child smuggled into the United States when they were 2 years old wouldn't be definitionally a criminal.
- MrRiddle 6y agoSure, there are edge cases. But if someone sneaks in/crosses outside of official border crossing they already committed a greater crime than most people ever will.
