Also felt the e-mail was trying very hard to make sense. I'd say yes, all devices opt-in, also upcoming ones. Unless you happen to read about the feature and act on it to opt-out. Or maybe the newer devices have it mentioned in the terms, which, as we all know, would be the ultimate move. The opt-out setting for it hasn't appeared yet, and will likely appear quietly sometime in the future when everybody's forgotten about it.
