(IANAL) This reads like an argument about agency. Is the tool (browser, python script, etc) used by the user separate from the user themselves? There seems to be some similarity to Connecticut v Amero case[1], though in reverse - where the actions performed by a tool (browser), which was corrupted (DNS highjack) were used to show intent on the part of the user.
