There is a lot of boilerplate language that attempts to disavow liability in the Tesla communications to customers. Given the substantial payments made to Tesla, the courts are going to impose liability on Tesla under theories of misrepresentation or contract law. The line will be crossed, and Tesla won't even know it, until the insurers, working on behalf of the individual insured 'drivers' pile onto Tesla.
