It's the same as using open source software: You are bound by the license and if you break the license you loose the permission to use the software and maybe even have to pay a fine to the copyright holders. Facebook willfully broke the conditions set for the merger, so now its time to reverse said mergers and if this means Facebook has to bleed then that's the price they pay for breaking the rules.
