In the US ID spot checks for pedestrians are unconstitutional. It should be obvious this should extend to nonpedestrian travel, otherwise the protections on travel are basically meaningless.
- Loughla 6y agoProtections on travel do extend to non-pedestrian travel which can be accomplished via non-spot-checked formats. You just have to drive instead of fly. I'm not trying to be hateful, but your argument just smacks of an 'I want what I want when I want how I want and will not take anything less than all of it' kind of argument. If you don't want your ID scanned, just drive, or take a train, or a bus. Just don't fly, right?
- occamrazor 6y ago> You just have to drive instead of fly. What about Hawaii? Is there any reasonable alternative to flying?
- Loughla 6y agoA boat? That's not meant to be flippant - that would be an alternative, I'm just not sure about the very subjective definition of 'reasonable'.
- occamrazor 6y agoA boat would be reasonable, maybe, but are there regular ferry services to Hawaii?
- Broken_Hippo 6y agoAnd don't get pulled over for any reason, since they'll probably ask for your ID and your passengers. It doesn't matter if it is illegal: If they can't do it, you are in for a bad day, even if they let you go at the end.
- R0b0t1 6y agoAccepting the partial abrogation of rights eventually leads to ceding even more. It is extremely important to reject half measures.
- kevin_thibedeau 6y agoIf your freedoms are subject to someone else deciding when you can exercise them you were never free to begin with.
- jandrese 6y agoDoesn't stop states from implementing Stop and Frisk policies. Technically they can't arrest you, but you also can't leave until the cops are satisfied.
- R0b0t1 6y agoThey have to arrest you within a definite time window otherwise you can leave. If you ask the question "Am I under arrest or am I free to go?" and you are not told you are under arrest, you may leave. Granted this may get you shot, but the hope is the court is on your side.
- jandrese 6y agoNarrator: The court was not on your side.
- alasdair_ 6y agoHow long is that time window? From what I have seem it’s trivial for the cop to say they need to wait for a drug dog etc. which can take many hours.
- R0b0t1 6y agoIn my locale in the US the only question you need to answer is what your name is and I'm not even sure of that. Afterwards you may leave and they can not hold you. The drug dogs are to my knowledge only if you're in a vehicle, and recently that has received challenges.
