I still don't really get what they did wrong? What their cars did was essentially equivalent to studying the test instead of studying for the test.

  Because what matters is the intent of the law, not the letter of the law. Otherwise, you end up with many spurious lawsuits like we see in the US.

  The test is a measure of impact. They intentionally lied about the impact of their cars.
