Maryland has not "outlawed" public schools. The decision whether to provide in person, remote or a mix is up to each local school board. Some have chosen fully remote and others mixtures of remote and in person.
One county health director in Maryland did try to prevent private schools from opening in person until October 1st but the authority to do so was quickly stripped from them. In any case this would not have affected "learning pods" which are groups of parents which join together to hire teachers and/or tutors to help either home school or supplement public school education. Parents are free to form learning pods.
