The SEC fails to catch or even detect the vast majority of market manipulation and insider trading. A volatile stock like Tesla has so much volume that a large amount of contracts (calls/puts) wouldn't even look unusual. They most certainly could have gotten away with some form of manipulation using Elon's (or someone else's) account and gotten away with it.
