- being treated differently by some party because that party had knowledge of private information about you is difficult to prove
The ultimate solution is to legally require that important services cannot depend on private information.
An example would be: define a set of properties health insurance cost is allowed to depend on, and then have health insurance providers publish their formula for the premium (that can only depend on that set of properties).

That's exactly how it works in Italy Parameters used to establish premiums must be approved and you can't make them in a way that target a small group or a single person
- zeroonetwothree 6y agoThis is likely to increase insurance costs on average. So it’s a tradeoff. It also has a big issue of adverse selection. Say everyone with some known “private bad health markers” signs up for insurance but the insurance can’t take into account. That’s not going to be great. So we need to be careful to allow enough to be taken into account.
