Not entirely true. H-1B is a dual intent visa which can be renewed unlimited number of times if someone applies for citizenship.
- cpufry 6y agoh1b is tied to employer though right? or is one able to change employers once they have an h1b visa?
- connor11528 6y agoH1b is tied to the employer correct. An h1b can be transferred to a new employer though. Would be good to check on USCIS site though because there may be a suspension of processing.. https://www.uscis.gov/working-united-states/temporary-workers/uscis-announces-temporary-suspension-premium-processing-all-i-129-and-i-140-petitions-due-coronavirus-pandemic https://www.uscis.gov/working-united-states/temporary-worker...
- connor11528 6y agoOkay interesting thanks for the clarification. So if you’re on path to get another visa you can stay past the 6 year mark. From an actual law office: > In other words, in order to be able to extend the H1B status beyond the six-year limitation and thus lawfully remain in the United States beyond six years without leaving the country, the H1B worker must be on the way to an immigrant benefit or adjustment of his or her nonimmigrant status to a permanent resident status. http://myattorneyusa.com/extending-h1b-status-beyond-the-6-year-statutory-limit http://myattorneyusa.com/extending-h1b-status-beyond-the-6-y...
- triceratops 6y agoThe H-1B is both non-immigrant and dual-intent. This may seem contradictory, but it's not. Non-immigrant means literally that: getting it doesn't make you an immigrant. In that way it's similar to a business/tourist or student visa. Dual-intent means basically "you may pursue immigrant status without negative effects". This is not the case for a business/tourist or student visa. If a consular or CBP officer believes you intend to immigrate when applying for either of those visas, they can deny you.
- wobbly_bush 6y agoI was referring more to the 6-year limit of H-1B as mentioned in the article.
