Florida HOA Threatens Nurse with $1k Fine over Quarantine RV in Driveway
- brudgers 7y agoThe homeowner's association has to because the prohibitions are part of the deed. Non-conformance with the terms of the deed invalidate the title to the land which was subdivided into individual lots such as the nurse's. That title is prior to the nurse's title and all the other owners in the subdivision. To put it another way, if the homeowner's association does not enforce the deed restrictions, the prior owner who transferred title to the land with the restrictions can claim ownership and that claim has a long and strong precedent in Common Law. To put it another another way, what owning means when we say we own a piece of land is not what most people think it means. It's a legal thing mostly to the advantage of the people who cooked it up. Those people being sovereigns.
