Don't see how it does or how the edge cases are elevant. It is there to prevent anyone from thinking public spaces are free game. It's also a very different thing to process an image and permanently mounting a camera in a public space. Something that already requires a license in many/most jurisdictions, and getting one is hardly trivial.
