The fact that other companies lie about their tech doesn't mean it isn't fraud, it just means other companies are also making fraudulent claims. A non-Theranos example might make it clear why I'm not nuts about the "if they'd succeeded, we'd be singing a different tune" argument: If alchemists had been successful in turning lead into gold, nobody would be calling them frauds now.
