In the UK silence can be taken as proof of criminality. In the US the following statement would mean there is no transcript:
"I'm asserting my 5th amendment right to silence not because I believe I have done anything wrong but because anything I say can and will be used against me in a court of law"
- philjohn 7y agoThe "miranda" rights in the UK are "You do not have to say anything. But, it may harm your defence if you do not mention when questioned something which you later rely on in court. Anything you do say may be given in evidence." But the usual advice of - don't say a damn thing until you have legal representation still stands.
