I didn't want to talk about law, it's surely illegal. We could talk abbout ethics, I don't believe the current rules for IP are fair. But let's simply talk about business opportunities - as others have pointed out, you can make money with free downloads and a donation button. Or bundling some advertisment with your product. Static content (e.g. music, books, most games,...) can and will be pirated, whining won't stopp anyone.
