- vixen99 7y agoFacts in a case shape decisions or should do. Parliamentary lawmakers can never anticipate the application of their laws to cover all possible disputes. Common law is evolutionary and recognizes our inability to be omniscient & lay down rules worthy of eternal justification. Moreover the logic in a case is preserved and provides a basis for deciding similar situations via precedent.
