It's nit someone remembering I ate a cheeseburger,they're writing down that I ate a cheeseburger and using that information for profit or to keep tabs on me,you need consent for that. They didn't notice I eat cheeseburgers as a matter of coincidence, they intentionally set out to see what food i eat and use that information. There is a term for that: stalking (which is illegal)
