I say it would be unfair to the tribe members to try them for something that violates our sense of right and wrong. They have never been part of the nation that occupies their territory, did not grow up with its values, never consented to be part of it. It would be like aliens monitoring Earth and trying inhabitants for violating intergalactic space law while none of the inhabitants are even aware they are part of it.
