Given that it's due to the lights, with the day time image usage being fine, I wonder if that means you could simulate a (new) photorealistic nighttime view based on a day time image and post that subtly different image without breaking the rules?! Obviously wouldn't be a photograph, so isn't going to help tourists, but might make enough of a point that they give up opposing it.
