Multiple self-driving car makers have studied the issue and have concluded that Level 3 is too dangerous for humans, because human reaction is too slow to deal with the imperfections of a Level 3 system, all the while "expecting it to work flawlessly 90% of the time." You can't just tell humans, "Hey, this works 90% of the time - it's up to you to decide when to take over that 10% of the time.
