Regardless of how the law was written, they didn't HAVE to take all the leeway that was given to them. Just because a company can do something, doesn't mean that they should. Just because it's not illegal, doesn't mean that it's okay. They found an opportunity to get people used to this sort of tactic, and they took advantage of it.
