that puts the responsibility on the platform instead of the user
What did they think would happen when they started making editorial decisions about what content to show and what to ban or at least bury?
They made their bed, let them lie in it.
- Aqua 8y agoAlthough you are obviously right and YTs censorship is well known, these are two unrelated things and an argument like that to justify bad law (which will not only affect YT, but other platforms as well) is inappropriate.
- xfitm3 8y agoI believe the comment is referring to safe harbor law, which I think is loosely related here.
- gaius 8y agoMy point is - they are demonstrably perfectly able to control what content is played and choose to ignore copyright to make more money.
- anticensor 8y agoCivil law copyright does not have enough safe harbor provisions for that.
- tengbretson 8y agoI don't see how you can consider them unrelated. If you are going to exercise editorial control over your platform you become responsible for (and potentially liable for) what makes it through to the public.
- gaius 8y agoIt seems so obvious to everyone who isn’t a Silly Valley bro. Total monoculture.
- matt4077 8y agoWhy? Did anybody think it was technically impossible for youtube to delete content before? Do you also believe that when you, just once, move a large branch that had fallen from a tree you suddenly become responsible for the safety of all the city's sidewalks?
- manigandham 8y agoIt's nothing technical. It's about deciding to delete or otherwise suppress certain content based on vague editorial terms, instead of being neutral and letting users control their feed with better tools. This is specifically content that has not otherwise been flagged by police or other authorities. Making editorial decisions like that does give lawmakers leverage to push for more responsibility.
- manfredo 8y agoModeration and curation are not the same thing. To say YouTube makes editorial decisions largely hinges on whether or not someone thinks programmatically primitive content viewers are likely to watch counts as curation, which seems a bit far fetched to me. The only curation I've seen YouTube do is highly limited in nature (e.g. promoting YouTubers of color during black history month).
