Complexity of our society is not easy to capture in a strict rules and law is already so complicated that even those who devote their lives to study it find it overwhelming. So whatever rules you create (and I'd say there are too many of them already), huge legal team at Apple will work their way through them. It won't be easy for a small startup though.
