I think the main problem is there are very few consequences for patent trolls. I consider this a form of extortion that our legal system is not structured to prevent (it actually encourages it). Invalidating and banishing all software patents would be a start.

That's what pains me the most. Anyone with half a brain can see that these people provide nothing of value and should be laughed out of court and punished for wasting everyone's time, yet that will never happen and they will continue to clog up the system with their BS.

The system is designed by lawyers, and ultimately protects lawyers. This is no coincidence.
