I've always wondered if it would be more fair to only pay for UPLOAD. Download all you want, but pay for everything you upload. It always seemed to me the best of both worlds. Those torrenting and serving large amounts of data (Netflix, etc) would be paying, and they're also responsible for the amounts of traffic as well.
