Code Theft, millions on stake: Is contingency better vs. straight fees?

A company in states has stolen our code and made several millions. Not part of code but the exact code. Now, the lawyers are offering us contingency based deals. As a startup, i wonder what's best for us. Any thoughts? Is it better?
