It doesn't matter who invented what first, Samsung deliberately infringed Apple's design patents and were found to do so by the court. As I understand it, design patents are different to normal patents in that prior art is not a consideration. Samsung could have gone in so many different directions with the design. Instead they came up with something that even their own lawyers had trouble distinguishing from an iPhone.
