Facebook should anticipate further class action lawsuits around the world
- stevespang 9y agoTexas Texas enacted its own biometric data law shortly after the passage of the BIPA. Similar to the BIPA in many regards, the Texas law required informed consent by individuals before organizations could begin collecting biometric identifiers. However, the consent did not need to be written. The Texas biometric law also imposed limitations on the sale of biometric information and set forth security and retention requirements. Only the Texas Attorney General can enforce the state's biometric law as the law does not provide for a private cause of action. READ: the law does not provide for a private cause of action. This is how Texas politicians keep the stream of corporate money flowing their way, just eliminate private claims, but keep the potential threat of Texas Govt. enforcement, and if/when the Texas OAG get's the nod to drop his hammer, facebook and all the others come a running to the legislature / politicians spending a huge chunk of change to avert being sued. When enough money passes hands, both sides smile, shake hands, and quietly the case is dropped. It's sorta the same thing going on in class action suits for defects. Both the plantiff representing the class - - and the defendant corporation that caused the harm - - agree to cover all the plantiff law firm legal millions in expenses, but just throw a bone (like a rebate coupon) to the class. A judge has to certify the deal, and often they are compelled to agree because they have a willing plantiff and a willing defendant, they need to get this case off their docket.
