  Aaron Swartz' situation is substantially different. Swartz knowingly violated the terms of service of JSTOR, and deliberately circumvented it's rate limiting. And he knew what he was doing was against the law, he even published a manifesto outlining his intentions to do this as a form of civil disobedience. The kid in this story just incremented sequential IDs on what was supposed to be public information.
