because it implies something regardless of the products ability to actually deliver. the connotations were so strong I found it bizarre they went with it and didn't just hold it until the product matured. however it really comes down to the simple fact it has not costed them enough money in penalties and lawsuits to force a name change. they are in essence bluffing their way through this and have yet to get called on it.
