"Some folks" in this case being primarily Abu Zubaydah, a top lieutenant of Osama bin Laden who was involved in plotting terror attacks against the U.S. (although not apparently 9/11). The "torture site" was legal under U.S. law at the time as was the destruction of the videos of the interrogations. Abu Zubaydah is still in Gitmo, but if he wasn't the U.S. would be trying kill him.
